With this Privacy Notice (“Privacy Notice”) we want to explain to you, how 4Artists Management handle your personal data when you are an existing or prospective customer or artist, you have signed up to receive marketing communication from us or you are using one of our websites, mobile sites and other digital services (“4Artists Management Sites”) that link to this Privacy Notice.
This Privacy Notice explains to you what personal data we collect about you, why we collect it, what we do with it and what rights you have in relation to your personal data. Please take a moment to familiarise yourself with this notice and let us know if you have any questions.

2.     What types of personal data do we collect?
We collect various types of personal data about you. Please note that the types of personal data that are relevant to you will vary depending on the relationship we have.
Contact information:
Name, address, email address, telephone number, organisation details (e.g. your place of work, job title and organisation contact information).
Identity and other regulatory information:
Date of birth, identification information (e.g. passport), health data (where required for business purposes and based on consent)
Business and financial information:
Details relating to our business relationship, including business related communications with you, information about other people (e.g. your customers, suppliers, vendors and/or staff) that you share with us in connection with our business relationship, details in relation to our projects and works (e.g. photos, videos or other involved people), work experience, your availabilities and preferences, travel information, information you provide to us when you come to our events or meetings, you/your organisation’s billing, payment and banking details, membership information, your responses to requests for feedback.
Marketing information:
Service interests, marketing communication choices or usage of our marketing communication (including whether you open them and click through to access their contents).
Usage and device information:
Information automatically generated through your use of 4Artists Management Sites such as your IP address, information about your device and operating system, your location and your use of 4Artists Management Sites.

3.     What do we do with your personal data and why?
We use your personal data for a number of different purposes. Please note that the purposes that apply to you will vary depending on the relationship we have.
Doing business with you:
Responding to your queries; Establishing you/your organisation in our systems; Providing you/your organisation with services you have requested from us; Managing bookings; Processing payments in respect of our services; Hosting you for our events or meetings; Sending you service related communication; Managing our business relationship; Resolving any complaints from or disputes with you.
Legal and regulatory compliance:
Keeping records; Maintaining the security and integrity of our systems, platforms, premises and communications (and detecting and preventing actual or potential threats to the same); Monitoring our systems and processes to identify, record and prevent fraudulent, criminal and/or otherwise illegal activity; Complying with instructions, orders and requests from law enforcement agencies, any court or otherwise as required by law; Complying with our general regulatory and statutory obligations; Obtaining legal advice; Establishing, defending and enforcing our legal rights and obligations in connection with, any legal proceedings (including prospective legal proceedings).
General business requirements:
Continuously reviewing and improving our services (including by seeking and obtaining your feedback) and developing new ones; Monitoring and producing statistical information regarding the use of the 4Artists Management Sites and analysing and improving their functionality; Managing the proposed sale, restructuring, transfer or merging of any or all part(s) of our business, including to respond to queries from prospective buyer or merging organisation.
Marketing:
Managing, planning and delivering our business and marketing strategies; Sending you information about similar and/or related services; Sending you marketing communication; Analysing how our marketing communication is used by you; Conducting surveys for benchmarking, continuous improvement and marketing purposes.

4.     With whom do we share your personal data?
We only share your personal data with other parties if this is necessary for the purposes described above, you have given us your consent, or we are obliged to do so by law.
We have relationships with various companies who help us operating our business and who may need access to your personal data for doing so, including the following: Prospective or existing customers, people who are involved in our projects and works, IT service providers, marketing service providers, social media platforms, business partners, professional advisors and consultants (e.g. law firms). We may also have the obligation or the right to share your personal data with government authorities (e.g. tax authorities), courts, court-appointed persons/entities or with receivers and liquidators. If we decide to reorganize or divest our business through sale, merger, or acquisition, we may share personal data about you with actual or prospective buyers.
We also share your personal data with other recipients, if you ask us to do so.

5.     What are our legal justifications?
We only collect and use your personal data if we have a valid legal reason to do so.
Your consent:
You have permitted that we can collect and use your personal data for a specific purpose. For example, you have consented that we can send you marketing communication.
Contract between us:
We need your personal data to comply with our obligations or to exercise our rights under a contract with you, or you have asked us to take specific steps before entering into a contract. For example, we need your contact details to respond to your queries.
Our legal obligation:
We need your personal data to comply with the law. For example, we need your payment details to comply with tax laws.
Legitimate business interests:
We need your personal data for a specific business interest and we do not see significant impacts on you that are stronger than our business interest. For example, we need your usage details to maintain the security and integrity of our systems, platforms, premises and communications.

6.     Do we transfer your personal data internationally?
Primarily, your personal data is processed in Germany and in other European countries. If, in exceptional cases, your personal data is processed in countries outside the European Union or the European Economic Area (so-called third countries), this only takes place insofar as certain protective measures ensure that an appropriate level of data protection exists for this purpose. Typically, we take the following protective measures for this purpose:

7.     For how long do we keep your personal data?
We will keep your personal data only for a limited period of time and for no longer than we need it for the purposes described above. In particular, we set our retention periods carefully under consideration of different general principles, including the following:
- whether we are obliged to keep your personal data (e.g. for tax purposes);
- whether you have asked us to stop using or instructed to keep your personal data;
- whether we have an existing business relationship with you;
- whether we will likely use your personal data in the future;
- whether your personal data is relevant to future legal claims;
- whether your personal data is particularly sensitive; or
- whether keeping your personal data would have a significant impact on you.

The most important statutory retention obligations result from Sec. 257 German Commercial Code (Handelsgesetzbuch) and Sec. 147 German Fiscal Code (Abgabenordnung) and are six and ten years respectively. The statutory periods of limitation can be up to thirty years in accordance with Sec. 195 et seq. German Civil Code (Bürgerliches Gesetzbuch), with the regular period of limitation being three years.

8.     Where do we collect your personal data from?
Primarily, we collect your personal data directly from you in the course of our business relationship, when you sign up for marketing communication or when you use one of the 4Artists Management Sites.
In some cases, we also collect personal data from publicly accessible sources (e.g. the Internet, the press, trade and association registers) or from other third parties (e.g. other artists).

9.     Do you have to provide your personal data to us?
We may ask you to provide certain personal data to us. You are not required to provide us with your personal data. However, if you choose not do so, we may not be able to enter into or continue a business relationship with you/your organisation or to provide you with marketing communication or to make specific content at the 4Artists Management Sites available to you.

10.  Do we use fully automated decision-making?
We do not use fully automated decision-making that has legal or other similar significant effects on you.

11.  What rights do you have in relation to your personal data?
You have various rights in relation to your personal data. Depending on the applicable data protection laws, you may have the right to:
- withdraw your consent;
- access your personal data and be provided with certain information in relation to it, such as the purpose for which   it is used, the recipients or categories of recipient to whom it is disclosed and the period for which it will be stored;
- ask us to correct any inaccuracies in your personal data;
- ask us to erase your personal data;
- ask us to restrict the use of your personal data;
- receive the personal data which you have provided to us, in a machine readable format; and
- object to the use of your personal data.

12.  How do we keep this Privacy Notice up to date?
We will update this Privacy Notice from time to time and we encourage you to review it regularly. Whenever we make changes, we will revise the “last updated” date at the top of this Privacy Notice. If the changes are significant, we will provide you with a more prominent notice as appropriate.
